Conservation Commission
Meeting
August 7, 2003

Peg Arguimbau Chairman, Janet Dunlap, Hank Langstroth, and Katherine Roth were the members present.
Peter Holden arrived at 8:15 p.m.

7:45 p.m.: Hearing Continuation, Glendale Village 40-B, ANRAD Modifications:

John Rockwood, Senior Environmental Scientist, from EcoTec, Inc., represented the Applicant.
Abutters were present in the audience. (See attached abutters list)
Mr. Rockwood submitted a revised site plan to the Commission prepared by Norwood Engineering, dated 8/6/03, entitled, "Complied Existing Conditions Plan, Glendale Village, on Rob's Lane, Sharon, MA."
Copies of the revised site plan were distributed upon request to those present in the audience.
The revised plan delineates the boundaries of the two depressions on the property that Horsley & Witten previously identified as vernal pools and defines the mean annual high-water line of Massapoag Brook and its associated 200' Riverfront Area. (On August 4, 2003, Greg met at the site with Mr. Rockwood to review the delineation of  the mean annual high-water line of Massapoag Brook).
Comments are currently pending from Massachusetts Natural Heritage and Endangered Species Program to verify the vernal pools that Horsley and Witten identified.
The abutters discussed their concerns with the Commission regarding the impact to the vernal pools and flood plain from the proposed new construction.
Mr. Rockwood requested from the Commission, the approval of the following resource areas:
Bordering Vegetated Wetlands (Flags A1 to Flag A39 and B1 to B16).
The Riverfront Area, A & B, based upon the mean annual high-water line of Massapoag Brook
     (Flags R1 to R30).
Bordering land subject to flooding does not occur on the site.  
Peg called for a motion to close the hearing and to issue an Abbreviated Notice of Resource Area Delineation in reference to the submitted Plan.
Hank moved. Janet seconded. Voted. Unanimous.

8:15 p.m., RDA Public Hearing, Mass Highway, Vegetation control, Rte. # 95:

Tom McGuire, District Environmental Engineer, from Mass Highway District 5 in Taunton, MA,
appeared before the Commission. He presented the Mass Highway Yearly Operational Herbicide Management Program for controlling the vegetation within the sensitive areas of the State Highways rights of way. The majority of the sensitive areas proposed for herbicide treatment are located along the median, along the roadside, ramp guardrail, jersey barriers, sign posts, within crevices between pavement and curbing.  
The herbicides that are dispensed by Mass Highway are approved by the Mass Pesticide Bureau.
Tom reviewed with the Commission, the Mass Highway Rte. 95 U.S.G.S. Locus Map dated 6/27/03 and Route 95 Mass Highway spray/no spray sketches dated 6/27/03.
The location of the proposed project is on Rte. 95, from the Foxboro/Sharon Town Line to the Sharon/Walpole Town Line and from the Norwood/Sharon Town Line to the Sharon/Canton Town Line, approximately 5.2 miles.
Peg called for a motion to issue a Negative Determination with the conditions as accepted relative to the expanded "No Spray Area Zone II" to reflect the "No Spray" area at Billings Brook.
Kathy moved. Hank seconded. Voted. Unanimous.

8:25 p.m., RDA Public Hearing, Mass Highway, Vegetation control, Rte. #1:  

The proposed project location is on Route 1 from the Walpole/Sharon Town Line to the Sharon/Walpole Town Line, approximately 1.9 miles.

8:40 p.m., RDA Public Hearing, Mass Highway, Cold Planing, Paving, Rte. #1 from South of Old Post Road to the Walpole Town Line:

Tom McGuire reviewed with the Commission, the Rte. 1 U.S.G.S. Locus Map dated 6/24/03. He explained that the proposed project is to excavate 2
Hay bales/siltfence will be installed near the buffer zones.  Loam and seed or crushed stone will be placed as needed to restore and stabilize the shoulders of the roadway.
Peg called for a motion to close the hearing.
Hank moved. Janet seconded. Voted. Unanimous.
Peg called for a motion to issue a Negative Determination with the condition that the office is contacted prior to the start of the proposed work to establish the installation of haybales and erosion controls.
Janet moved. Hank seconded. Voted. Unanimous.

9:00 p.m. N.O.I. Public Hearing
Jay Rosenbaum appeared before the Commission. Abutters were present in the audience. (See attached abutters list) Forrest Emery, Consultant from Phoenix Environmental Group, represented the Applicant and reviewed submitted site plans dated July 5, 2003, with the Commission.
Forrest explained to the Commission that the existing lot is approximately 35 ' long by 35' wide, and the actual useable area will be approximately 30' long by 15' wide. There is an existing old stone retaining wall. The proposed project is for construction of a SRW Modular Block Wall upgradient of the mean annual high-water line of Massapoag Brook to stabilize the existing private lake front recreation area within the 100' Buffer Zone to a BVW and Inland Bank.
Hank stated that the base of the proposed wall and the top elevation of the wall should be outlined on the proposed Plan.
The extent of the proposed work does not extend below the high water mark.
Comments are pending from The Natural Heritage and Endangered Species Program.
Plans for the proposed project involve the removal of a red maple tree and a gray birch tree on the property as well as the removal of some plants/vegetation. (Peter stated, if possible, efforts should be made to preserve the trees and some of the native plants/vegetation).
The Applicant proposes to fence in an area of the parcel.
The Commission answered the following questions from the abutters present:
How the level of the high water mark of the lake is determined
How the construction of the  proposed project will impact the surrounding lots
Peg concluded that the Commission would review the proposed project site and to continue the Hearing.
Peg called for a motion to continue the hearing until August 21st.

9:15 p.m.  N.O.I. Public Hearing- Chabad Center, Camp Gan Israel, South cove, Lake, restoration of  altered beach front:
                Due to the applicant's absence, Peg called for a motion to continue the hearing until
                notified by the applicant.
                 Janet moved. Kathy seconded. Voted. Unanimous.
9:35 p.m.: Signatures:
 The Commission signed Abbreviated Notice of Resource Area Delineation for
 Glendale Village. Negative Determination for Mass Highway Rte. # 95 herbicide treatment for vegetation control. Negative Determination for Mass Highway Rte. # 1 herbicide treatment for vegetation control. Negative Determination for Mass Highway cold planing,  paving, Rte. #1.

9:45 p.m.: Other Business:
                
         George Bailey met with the Commission and requested the following water resource
                  information:
The recorded lake level data pertaining to Lake Massapoag from the year 2000, to date,  including staff gauge readings, flow rate readings, as well as gate level settings at the Flume  House.
The Commission determined that Greg would provide the recorded information available in the office files to Mr. Bailey, as requested.

9:55 p.m.: Approve Past Meeting Minutes:

              Peg called for a motion to approve the June 19, 2003, Meeting Minutes.
                 Hank moved. Janet seconded. Voted. 4-0-1.

                 Peg called for a motion to approve the July 10, 2003, as amended.
